1. General Terms
Welcome to The O2 Hotels & Restaurant. By making a booking, placing a food order, or using any service provided by us — whether online, via phone, or in person — you agree to be bound by these Terms & Conditions.
These terms apply to all guests, visitors, event organizers, and customers ("Guest" or "You"). We reserve the right to update these terms at any time without prior notice. Continued use of our services constitutes acceptance of the revised terms.
- These terms are governed by the laws of the Republic of India.
- All disputes shall be subject to the exclusive jurisdiction of courts in District Samastipur, India.
- If any provision of these terms is found invalid, the remaining provisions remain in full effect.
2. Hotel Stay — Booking & Room Policy
2.1 Reservations
- A booking is confirmed only upon receipt of a confirmation message/ID from us.
- Room availability is not guaranteed until a booking confirmation is issued.
- The hotel reserves the right to refuse accommodation to any guest at its sole discretion.
- Booking details (dates, room type, number of guests) must be accurate. Any discrepancy may result in cancellation or additional charges.
2.2 Room Occupancy
- Maximum occupancy per room is as specified at the time of booking. Extra guests will be charged additionally or refused entry.
- Rooms are assigned based on availability. A specific room number cannot be guaranteed.
- Children below 5 years of age stay free when sharing a room with parents (no extra bed).
- Pets are not permitted on the premises.
2.3 Damage to Property
- Guests are liable for any damage caused to hotel property, furniture, fixtures, or equipment during their stay.
- The cost of damage will be charged to the guest's account or recovered by legal means.
- Theft of hotel property is a criminal offence and will be reported to the police.
3. Check-In / Check-Out & ID Requirements
Mandatory: Valid Government-issued Photo ID is compulsory for all guests at check-in. This is required by law under Indian Hotel & Tourism regulations and Police Act provisions.
- Standard check-in time: 12:00 PM. Early check-in is subject to availability and may incur additional charges.
- Standard check-out time: 11:00 AM. Late check-out is subject to availability and may be charged at the applicable rate.
- All adult guests (18+) must present a valid original photo ID at check-in: Aadhaar Card, Passport, Voter ID, Driving Licence, or PAN Card.
- Foreign nationals must present a valid Passport and Visa. Form C registration will be completed as required under the Foreigners Act, 1946 and Foreigners Order, 1948.
- Unmarried couples must present valid ID. We comply with all applicable local laws. No documentation of relationship status is mandatory under Indian law for adult guests.
- Guests under 18 years of age must be accompanied by a parent or legal guardian with valid ID proof.
- The hotel reserves the right to deny check-in if valid ID is not produced.
- Guest information collected at check-in may be shared with law enforcement authorities as required by law.
4. Guest Conduct & Prohibited Activities
All guests are expected to conduct themselves in a lawful and respectful manner. The following activities are strictly prohibited on all hotel, restaurant, and event premises:
- Possession, consumption, or distribution of illegal drugs or narcotics (punishable under the NDPS Act, 1985).
- Gambling in any form (punishable under the Public Gambling Act, 1867).
- Any activity related to prostitution or soliciting (punishable under the Immoral Traffic Prevention Act, 1956).
- Possession of unlicensed weapons or firearms (Arms Act, 1959).
- Consumption of alcohol in prohibited quantities or in a disorderly manner.
- Loud noise, music, or disturbance beyond permissible levels (10:00 PM – 6:00 AM).
- Harassment, abuse, or threats to hotel staff or other guests.
- Tampering with fire safety equipment, CCTV, or electrical systems.
- Smoking in non-designated areas (COTPA, 2003 compliance).
- Unauthorised use of hotel facilities by non-registered guests.
- Any activity that violates Indian Penal Code (IPC) / Bharatiya Nyaya Sanhita (BNS) provisions.
Violation of any of the above will result in immediate eviction without refund and may lead to a police complaint / FIR being filed. The hotel reserves the right to hand over any offender to the relevant authorities.
5. Cancellation & Refund Policy
5.1 Hotel Booking Cancellation
- 72+ hours before check-in: Full refund (minus payment gateway charges, if any).
- 24–72 hours before check-in: 50% refund of the total booking amount.
- Less than 24 hours / No-show: No refund. Full amount is forfeited.
- Cancellations must be communicated via phone or email to our front desk.
- Refunds will be processed within 5–7 working days to the original payment method.
5.2 Event / Banquet Cancellation
- 7+ days before event: Advance amount refunded minus 20% processing fee.
- 3–7 days before event: 50% of advance is refunded.
- Less than 3 days / Same day: No refund on advance amount.
5.3 Restaurant Orders
- Once an order is placed and accepted by the kitchen, it cannot be cancelled.
- Refunds for wrong/incomplete orders will be evaluated on a case-by-case basis.
- Refunds are not provided for food that has been partially or fully consumed.
6. Restaurant & Food Ordering
- Menu items, prices, and availability are subject to change without prior notice.
- We take reasonable care to avoid cross-contamination, but we cannot guarantee that our food is free from allergens (nuts, gluten, dairy, etc.). Please inform staff of any allergies before ordering.
- All food is prepared fresh. In case of any complaint regarding food quality, please contact the manager immediately — we will not be able to address complaints after food has been consumed.
- Home delivery is available within our specified delivery radius. Delivery times are estimates and may vary.
- Dine-in guests must vacate the table within a reasonable time during peak hours to accommodate other guests.
- Children must be supervised by parents/guardians at all times in the restaurant area.
- The restaurant reserves the right to refuse service to any person who is intoxicated, disorderly, or disruptive.
- All prices are inclusive of applicable taxes (GST) unless otherwise stated.
7. Events & Banquet Booking
7.1 Booking & Advance Payment
- All event bookings require an advance deposit to confirm the reservation. The booking is not confirmed until the advance is received.
- The remaining balance must be settled before or on the day of the event.
- Maximum guest capacity of the venue must not be exceeded under any circumstances (fire safety compliance).
7.2 Event Rules
- External catering is not permitted unless expressly authorized in writing by management.
- Decoration, music, and entertainment must be arranged by the event organizer and cleared with the venue management in advance.
- Music and entertainment must cease by 10:00 PM unless prior written permission has been obtained from local authorities (Noise Pollution Rules, 2000).
- Consumption of outside alcohol is not permitted. Only beverages served by the hotel/restaurant may be consumed on premises.
- Fireworks, crackers, and open flames are strictly prohibited inside the venue (Fire Safety Act).
- Any damage to the venue, furniture, or equipment caused by event guests will be charged to the event organizer.
- The organizer is responsible for the conduct of all their guests during the event.
Illegal or unlawful activities during any event on our premises will result in immediate termination of the event, police complaint, and forfeiture of all payments made.
8. Payment Terms
- We accept cash, UPI, debit/credit cards, and online payments via Razorpay.
- Online payments are processed securely via Razorpay. We do not store any card details on our servers.
- All prices are in Indian Rupees (INR) and include applicable GST unless stated otherwise.
- In case of payment failure, please do not rebook immediately — contact us to verify your payment status.
- Service charges, if applicable, will be clearly displayed before payment confirmation.
- Disputed transactions must be raised within 48 hours of the transaction.
9. Privacy & CCTV Surveillance
CCTV Notice: The premises (lobby, corridors, common areas, restaurant, and parking) are under 24-hour CCTV surveillance for security and safety purposes. Footage may be shared with law enforcement upon request.
- Personal data collected at check-in (name, address, ID details, phone) is stored securely and used for registration, communication, and legal compliance purposes.
- Guest data may be shared with law enforcement agencies as mandated by law (Police Act, IPC/BNS).
- We do not sell or share personal data with third-party marketing companies.
- By sharing your phone number, you consent to receive SMS/WhatsApp confirmations and updates related to your booking or order.
- CCTV footage from public/common areas may be accessed by police/authorities without prior notice as required by law.
- Guest rooms are not under CCTV surveillance to protect guest privacy.
10. Liability & Disclaimer
- The O2 Hotels & Restaurant is not liable for loss, theft, or damage to personal property of guests. Valuables should be kept in the safe (if available) or with hotel reception.
- We are not responsible for personal injuries arising from misuse of hotel facilities, negligence of the guest, or third-party actions.
- We are not responsible for vehicle damage or theft in the hotel parking area. Parking is at the owner's risk.
- Our maximum liability for any claim is limited to the amount paid by the guest for the specific service in question.
- Force majeure events (natural disasters, government orders, civil unrest) beyond our control shall excuse performance of our obligations.
11. Governing Law & Dispute Resolution
- These Terms & Conditions are governed by and construed in accordance with the laws of the Republic of India.
- Any dispute arising out of or in connection with these terms shall first be attempted to be resolved through mutual discussion.
- If unresolved, disputes shall be submitted to the exclusive jurisdiction of the competent courts in Bihar, India.
- Consumer complaints may also be raised with the appropriate Consumer Disputes Redressal Forum under the Consumer Protection Act, 2019.
